Transition Period and Prior Approval
On 1st September the new amendments to the The Town and Country Planning (Use Classes) (Amendment) (England) Regulations 2020 some into effect.
BUT it is important to note that because of the changes to the Use Classes Order and the changes to the General Permitted Development Order there will exist a bit of a cross-over period during which both the ‘permitted development’ (prior approval) rights under the GPDO together with the new rights to change uses under the revised Use Classes Order regulations.
So, there will be a ‘transitional period’ that lasts from 1st September 2020 until 31 July 2021. This means that the rights under the GPDO (e.g. office to residential conversions) will continue to be available as if the UCO had not been amended for a limited transitional period up until 31st July 2021. So, you can use either the rights allowed under the GPDO or the newly introduced changes between use classes.
